1. A sizable part of the science used to determine the legal limits has a critical flaw. When blood samples fortified with THC are stored at -20 Celsius, up to 70 % of the initial THC is lost. When blood level A is paired with impairment degree B, there is a risk that blood level A is much lower than what was the case. Meaning that the limits might be artificially low.
1.a) When blood from drivers are collected, they are stored at 2-8 degrees Celsius, a temperature where very little THC is lost. Meaning that there is a real risk that representative blood levels are measured up to an artificially low legal standard. A lot of people will be punished for driving under the influence, when in reality they were sober.
2. Any given blood level of THC below a certain treshold (say: 10 ng/ml in whole blood) can mean that the owner of the blood has smoked cannabis a few hours a go or that he likes to smoke a bit more often and that the amount of THC is residue from use a few days ago. The Supreme Court of Norway does not differentiate. Lower limit in Germany is 3,5 ng/ml. Norway 1,3 ng/ml.
